Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tixsy ("we," "us," or "our") governing your use of our websites, apps, and services (the "Services"). By creating an account or using the Services, you agree to these Terms. If you don't agree, don't use the Services.
1. Who we are
Tixsy is a marketplace that connects event organizers with attendees. Organizers list and sell tickets; attendees discover and buy them. Tixsy is not the organizer of the events listed unless expressly stated. The organizer is solely responsible for their event, including its content, conduct, and any refunds.
2. Eligibility & your account
You must be at least 13 (or the age of digital consent where you live), and old enough to form a binding contract to make purchases. You are responsible for activity under your account and for keeping your password secure. Keep your information accurate, and tell us promptly of any unauthorized use.
3. Buying tickets
- Prices, fees, and availability are set by organizers and shown at checkout before you pay, along with applicable service fees and taxes.
- Payments are processed by our third-party payment processor; by purchasing, you authorize the total shown to be charged to your payment method. A completed purchase is a binding order, and your ticket is delivered electronically.
- You agree not to resell tickets except where expressly permitted, or to buy them using bots or other automated means.
4. Refunds, cancellations & changes
Refund and cancellation policies are set by the organizer and shown on the event. If an event is canceled, postponed, or materially changed, the organizer is responsible for refunds under their policy and applicable law. We may facilitate refunds on an organizer's behalf but are not responsible for an organizer's failure to honor them.
5. Organizers
If you create or manage events, you also agree that:
- You are responsible for your events, content, pricing, and honoring your stated refund policy.
- You have the rights to the content you upload and your events comply with the law.
- You will use attendee information responsibly and only to run your event.
- Payouts are subject to our and our payment processor's requirements (including identity verification) and may be withheld for fraud, chargebacks, or policy violations.
6. Acceptable use
You agree not to break the law or infringe others' rights; post false, fraudulent, or harmful content or list fake events; interfere with or attempt unauthorized access to the Services; or scrape, reverse-engineer, or misuse the Services.
7. Content & intellectual property
The Services — including their software, design, and the Tixsy name and logo — are owned by us and protected by law; we grant you a limited, personal, non-transferable license to use them as permitted by these Terms. You keep ownership of content you submit (such as event details and images) and grant us a worldwide, non-exclusive, royalty-free license to host, display, and use it to operate and promote the Services. You are responsible for the content you submit.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that events will take place as listed. The Services rely on and may link to third-party services, which are governed by their own terms and for which we are not responsible.
9. Limitation of liability
To the maximum extent permitted by law, Tixsy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid Tixsy for the transaction giving rise to the claim or US $100.
10. Indemnification
You agree to indemnify and hold Tixsy harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, your events, or your violation of these Terms or the law.
11. Termination
You may stop using the Services anytime. We may suspend or terminate your access if you violate these Terms or to protect the Services or other users. Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and the state and federal courts located in New York will have exclusive jurisdiction over any disputes, except where prohibited by applicable law.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Services means you accept the revised Terms.
